An encroachment refers to a part of a building that extends beyond the property line and thus stands on the neighboring property. An encroachment can occur, for example, when a balcony or a rooftop terrace extends onto the neighboring property. An encroachment can have legal consequences and may result in the affected owner being required to remove the encroachment or pay compensation to the neighbor. However, encroachments can also be authorized through neighborhood agreements. In this case, the owner responsible for the encroachment pays the neighbor a so-called encroachment fee. Encroachment rights can also be secured as an easement in Section II of the land register.
